A very close friend of mine was at a party with me, she had never drank before,(our co workers) was having a great time untill some people were startting to get out of hand. A girl name Jane was the one that never knew how to dance and started to dance like Shakira, she was the one that was whacked. Her friend Jill was not as whacked, enough to talk and walk almost in a straight line was fight ing with the host when she turned off the music. They begged Jane not to leave and she wanted to go home, so jill started to fight with the guest and hostes everyone was trying to stop jane from leaving, e and my other friend Byonca offerered several times to jane to take her home, jill kept inter fering then, jill pulled the keys for jane's car out of the hostes husbands hand, he said your on your own now, jane didnt want to go jill pulled her and put her in the passenger seat and drove off, jill was driving.She never came back to work. But jane doesnt know what happen and why she in hospitle.

WHAT? If Jane wasn't driving, she can't be liable. At least thats what I got from all that. Jill drove, its her fault.

It is Jane's car. If there aer wittesses as you say to Jill getting behind the wheel can Jane may still be liable to some degree depending on insurance but she may have to file a suit against Jill. Was Jane found behind the wheel? If she was then she will probably be liable. You don't have enough facts to determine muchm yet.

You say all this about the party, but what about details of the car accident????

like...

- what was the other car's actions
- what was the inebriation levels of the people in the other car
- who were drivers at the ACTUAL time of the accident
- did these people observe all traffic rules
- were there witnesses to this accident
- was there any extra curricular activities going on in either car to distract the driver




too many details left out of your story.....

I have a hunch there's a police report on some of these details
I have a hunch the hospital has a record of how she got there, WHY, and for how long
I have a hunch there's someone from the other car in the hospital too

That person is still liable, but the people at the party have to take
some of the blame as well. They should have kept her there or
at the very least called her a taxi.
