From the legal standpoint, probably. You don't say where you're from so you need to check your state statutes.
From the common-sense standpoint, stop. Just stop. Think about what you're asking! You're asking about a number. How old this person is has nothing to do with whether they're ready emotionally.
Sex is supposed to be about GIVING, not taking. Your question shows an incredibly selfish nature because your concern is about whether you're breaking the law, and has nothing to do with what this might do to the 16-year old emotionally.
If you really think you're mature enough to have sex (and from what I see, you aren't), then find someone your own age or older. You only see 2 years... but those two years are huge.
Now, I dare you to do the right thing.

If you have sex with someone under the age of 18 it is against the law its called satutory rape and you put alot at risk like if charges were pressed youd be labled through the court system as a "pedifile" live the little girls alone and find someone who is your age this way you dont risk jepordizing anything in your life

Depend on what the age of consent is in your state. Here its sixteen. Most places its 16 or 18. So I guess according to the law its illegal.

I certainly wouldn't without checking the local laws. I am not sure if 16 or 18 would be necessary for your partner.
That said, if you should decide to proceed at some point, be sure to be safe and make good decisions and be respectful.

It's against the law if ur just gonna have sex, but its not if your parents and her parents say its okay that u 2 be together..! I was 15 and my b/f was soon to be 18 and he got me pregnant, but my parents and his were okay with it, b/c they knew that he was gonna take care of me. But if u want to, u might was check out your local laws just to make sure ur not gonna get into trouble...!

i cant say anything cuz when i was 16 i was having sex with a 22 year old.im 20 now and he will be 26 on dec 10th. we are now happily married,have a 2 1/2 yr old and now 9 mths pregnant. good luck though.

yes until she turns 16, that is the legal age of consent. but when she is 16, you can be 42 months apart and legally have sex. so just wait a little bit. k bud.
