Your neighbor is acting irrational, you are unsure what the problem is..He kicks your door down, is visably upset, and tells you he is going to kill you and your family. You see him walk to his truck where there is an empty gun rack visable. You live at the end of a Cul de sac..and your kids are playing basketball in the street 5 houses down..you have a gun and know how to use it....you have no doubt in your mind that he will harm you and your kids if he has the chance..he is 30 feet away from you...What would you do...would you shoot him?..If so, at what point? would you wait for him to reach the truck? open the trucks door? Start his engine? drive towards your kids?

Just me in danger? I'd never ever take his life and I'd never ever stop trying to calm the deranged man down. I wouldn't let him hurt me, though and would try to leave the area. But, and ask my family, if anyone threatened my children, I go after them and become deranged myself. That's not right, though. It's just the contagion of the violence and I am human. Try putting estrogen in his water. If this is actually happening in your life, remove your family from danger immediately and get an attorney.

I would shoot him. If he grabbed the gun and made a motion as if he were preparing to fire the weapon at me or anyone else, I would shoot him. He already displayed the three requirements for the use of deadly force. He displayed intent by saying he was going to kill me and my family. He displayed the means by having a gun in his possession. All he has to do is now display intent. He would then be shot center mass. He couldn't be shot until he made the attempt though. You couldn't shoot him because he got in his truck. He may be leaving and may not even have a gun with him.

Wait...how is this a different question? You still have a psycho threatening you and your life....I guess this time he's not on your property?
Since the guy is between me and my kids, I wouldn't shoot (yet) in case I missed and hit my kid. But I would definitely get to a better angle before he got into the truck.

When answering this question one would have to think reasonable. You can't shoot someone who you think might harm your family. If you have any reason to believe that then call the police and have them write a report. And few individuals would harm kids, most likely the anger would be towards you!.

Well if you know how to use the gun I say, wing the guy or hit him in the leg. Slow him down, but don't kill him. Let the cops sort it out, but if you fear for your life or the life of your family I don't think there a question, you have to stop the guy.

He made a terrorist threat and appears to be in the process of carrying it out.

the only time you'd be allowed to "shoot" him if you want to claim self defense is he is actually threatening your kids directly (ie aiming his gun at them) or you.
Until he aims that gun / weapon at you or your children, you cannot "shoot" at all.
If you had that much time for him to go out to his truck to notice he had a gun rack, you had time to call the police.
