Unfortunately, since the vegetable involved was a turnip, no. Now had you been really not choking on a vegetable that looked like a phallus, depending on the state, you could sue him for reduction of pleasure.
And are you sure it was the Heimlich? If it was the "Hindlick" instead, you may be able to. Providing he had made mention of saving you from a fruit, and not a vegetable.

Not unless you repeatedly asked the waiter to stop or he/she seriously injured you. If you let him/her perform the Heimlich, then the waiter can argue that he/she thought it was for the benefit of your health. Don't waste your time.

What are you going on about. Suppose you were choking and the waiter saved you from choking to death, would you not be eternally grateful?
Instead of pretending to choke next time think about what it must really like to choke. Your a pratt of the first order.

No, because a turnip was involved. If it were an artichoke, you might have a case because you could say he just assumed you were artichoking.
