First Degree Murder is - Something a person plans out

Second Degree Murder is - An unplanned murder (Sometimes droped to manslaughter depending on the mitigating circumstances.)

Third Degree Murder is - A completely unintentional murder (Such as in a traffic accident) Also can be dropped to manslaughter.

Murder is the killing of another human being.

Some states have classified murder for purposes of punishment and it varies from state to state. Not all states use the same terms so these are general things to look for. In general the three catagories are:

Worst - premeditated, felony murder, planned, poison, lying in wait. (usually 1st Degree would be this).

Next worst - Shooting, stabbing or killing someone in a fight.

Least - "Manslaughter" - 3rd Degree - killing someone in a car accident, doing something stupid that results in death without any intent.

First degree is premeditated murder. Second degree murder, or manslaughter is killing someone accidentally or unintentionally such as in a car accident or in a fight. Third i am not so sure of, but I believe that it is self defense. Not sure though.

The second definition of first degree murder is causing the death of another person while committing or attempting to commit another crime like sexual conduct with a minor, sexual assault, molestation of a child, various drug-related crimes, kidnapping, burglary, arson, robbery, escape from jail, child abuse, or unlawful flight from a pursuing law enforcement vehicle, or while fleeing from the scene where you committed any of these offenses.

The third definition of first degree murder is causing the death of a law enforcement officer in the line of duty while intending or knowing that the conduct will cause the officer's death."

Basically, first is where you planned ahead of time to kill the person. Second is where you killed the person in the heat of the moment or in reaction to some event.

Manslaughter is by accident killing somebody. First degree homicide is whilst they could coach you planned to do it. i'm uncertain approximately 2nd degree or 0.33 degree. i think of those conceal "crimes of interest" once you lose your temper and intentionally kill somebody. A 2nd degree homicide conviction will certainly deliver you to penal complex.
