My paycheck was recently given to the wrong employee (same last name). The store didn't notice, the other employee didn't notice, and the bank even took the check. It took 4 days just to figure out the above information. The store told me to check back the next day to see what was going to be done. The next day, the store manager tells me that the other employee should be writing me a check and calling me to get the check to me. It's been 5 days and I haven't received a call. I don't think it's right for me to have to get her info and try and track HER down to get MY money. Also, she now has my paystub with my personal info. Is there anything I can do, maybe legally against the store or the bank for this kind of error? Should I just suck it up and take care of it myself? This is so frustrating!

Well it is not theft if when the other employee cashed your check she believed it to be hers (i.e., no intent to deprive you of your property=no criminal liability for theft). However, it IS your employers fault and they are the ones who have to issue you another check and get the money back from the employee (which is their problem). Visit HR, if that doesn't help call your local EEOC office. I know they oversee wage a payment issues (mainly for fairness and overtime pay cases) but they should be able to either help or point you in the right direction (as it is unfair to not be paid ;-). Final option is sue your employer for payment, you have a cause of action - they owe you money and they haven't actually paid it to you have they? Go in there and ask them - Where's my CHECK!!!

Did you get a check at all? That would be a red flag to me that something was wrong and something your company should have taken care of immediately.

While I do not know the laws on this I would be a little upset. I would also expect my employer to fix it right away. They made the mistake they need to rectify it immediately. There is no reason you should have gone that long without your check.

1. Apply for Direct Deposit.
2. Get a (free) copy of your credit report. I'm assuming you're in the US, if not ask your bank for help in getting a copy.
3. Put an alert on your credit reports. This way no one can open a credit card account in your name.
4. Talk to your Supervisor & HR department -- ASAP

You seem to have a lot of options.... the bank didn't check signatures they could be at fault but I think the store should reissue you a new check and then let them take care of getting the money back!!! It was not your fault they are responsible.

File a police report! It's called theft. And it's not your responsibility to recoup your money, it's your employers!

No, you are essentianlly being denied your pay. Doesn't really matter to you what the companies problem is. Contact HR.
