Can trespassers really DO that in America? Claim that they have a right to continue trespassing on someone else's property simply because they've been getting away with it for a long time? Can bank robbers get a license to rob banks if they can show a court that they've successfully robbed several banks in the past and that they've gotten away with it every time so far? American laws sure are strange in some ways.

Yes, a "trespasser" can get an easement if their use of the land continues undefended for whatever period of time stipulated in law.
Consult with an attorney to see if you even have a right to object.

It sounds like you are describing an "easement by prescription".

Is someone wating to soak their feet or something?
Sorry, wish I could help but it seems to be written in legalese. Hopefully since it is dark a lawyer might be about.

contact your local county recorder. They should be able to tell you how to proceed.
