America is a free country, but you have to consider the health of other people. Second hand smoke is deadly, and the other people in the building you're at don't really have a choice if you decide to smoke. You wouldn't want some innocent person to die from your second-hand smoke, would you?

When one person's freedom potentially infringes on another person's freedom, then there have to be some guidelines in place so everyone's freedom is protected. In the case of making public areas smoke-free, this law is in place to protect the rights of anyone who is a non-smoker and does not want to be exposed to second hand smoke. Smokers are not being told they can no longer smoke, they are simply being told that there are regulations to where they can smoke. It is not any different than you have the right to drive from Columbus to Cincinnati. But, the law says you must follow the traffic signals, the speed limit, and wear your seat belt. Some people look at those laws as taking away their freedom. But, because how you drive affects other people, there must be guidelines for all to follow so everyone is safe. It is not any different with smoking laws. When a person smokes in public, others are affected. We have had smoking limitations in our state for several years. Some smokers put up a fuss about it at first (some using the same argument you use), but it is just a fact now and everyone follows the rules. If the Ohio smoking law was passed by the majority of the vote, then this is an example of what it means to have freedom in this country. The majority of the people who voted wanted this law and it is now the government's responsibility to put that law into affect.

You still have the right to do what you want but you can get into trouble for it.
I have no problem with you smoking but when I have health problems from second hand smoke are you going to pay for my doctor bills?
I do not know what no-smoking law passed but you always have the right to get the decision passed, contact a lawyer and see what you can do, especially if you think your rights are being taken away.

Your right to swing your arm ends at the tip of my nose.
This is a saying an old government teacher used to explain that there are curbs on freedom.
And in a very close and similar way, your right to smoke ends when the smoke can reach the nose and lungs of another.

There are several laws that state it's illegal to do things that are harmful to another person.
It's illegal to assault a person by hitting them.
It's illegal to knife or shoot another person.
It's illegal to run somebody over with your car.
Second hand smoke falls under things one person that can do that will harm another person. As an asthmatic, I can't spend more than a couple minutes in the presence of cigarette smoke before I start wheezing. So it is definitely something my body regards as an attack on my physical health and safety.

Because this imposes on others' right to breathe air instead of smoke. One said that a smoking section in a restaurant is like a peeing section in a pool. Yeah-thats how many feel about it.

Smokers have become a persecuted minority based on concern for the health of exposed non smokers. Why aren't we banned from getting drunk in public???
