and what chance do i have of getting my money back if the seller is unverified and has no money in their paypal account

yes you can and they will give you money back and they will probably take that person to court and you may have to go to that but it will work out in some way. they have some incredible stuff in their paperwork that can really help you out.

If ebay had nothing to do with it, you need to file the claim through paypal. Even if the seller is an ebay seller, if this transaction was done without ebay as the "middle person", they won't do anything.

File a claim directly through paypal.

there are lots of scams going on.
you can file a claim with paypal even if it was not ebay.

I would definitely file a claim...first though, try contacting the seller (if you haven't already).
