No. The landlord would be required to tell the tenant information pertinent to the living conditions in the appt. Things like broken appliances, health hazards etc. Hauntings don't count.

As far as I know the answer would be no they do not have to say anything about it to a new tenant at all but the real estate agent must do so I think. I am in Australia here and if you are from overseas that I do not know at all about the laws in different countries.

In Texas, on the SALE of a property, if a death happened due to violence (murder, drive by shooting, spousal abuse) it MUST be disclosed. If it happened due to condition of the property (railing gave way, etc) then it MUST be disclosed. If a death due to natural or other causes (old age, cancer, aids, car fell off jack stands, etc) then it should not be disclosed. I'm not sure about the laws on renting apartments are, but I'd expect them to be similar.

As a listing agent, if you asked me directly "Has anyone ever died of cancer or aids her?" My response would be "I won't answer that question any more than I'd tell you if a (Black/Hispanic/White/etc) person ever lived here."

I don't know about legally but it is morally wrong to keep something like that from the new tenant!

If you ask directly, they have to answer honestly. If you don't ask, they are not required to tell you about the inhabitants, just the structure itself.
