You should see a doctor if you experience any pain, discomfort, bowel movement problems or if you just feel like it.
I am guessing that a few pieces of plastic will pass through you with no problem, in which case, count yourself lucky that you got a refund.
If you feel that you have a legal case against the store, then seek the advice of a lawyer in your area.
Good luck!

it's probably nothing. You could make a bigger complaint to the manager, but I doubt you'd get more than a gift certificate. Or try and complain to the company, maybe you'll get a free tub of ice cream. But with no damages, you won't get anything, unless it was something done intentionally. If a lawyer did take this, the chances of getting anything out of it would be slim, and not worth your time. Stories of the McDonalds coffee burn are not what they appear to be (check out the real story), when juries give out huge awards for minor things like eating some plastic, the judge usually makes you take a smaller amount, or you'd lose on an appeal.

I got a milkshake in Ft. Collins on Thursday and it had tons of white plastic mixed in. After telling the manager, she poured me another one. On the first gulp, I got three peices of plastic. I just sent them an email.
Where did you buy your shake. Are you in Colorado?

you probably could get a lawyer, but since you went injured (far as we know) the case most likely wouldnt stand in court...i would just settle for the refund

No. Leave it be, unless you are sick.
