Intially I bounced a check believing that I could get the money in the bank before the transaction went through. Low and behold the bank system was down for cash advances. So I still have a fine to pay and they have given me ten days and ofcourse I dont get the letter till 2 days before the due date. Also I had the money ready before I got that letter and ofcourse they didnt take the money because I didnt get my notificationo in the mail. Can I work out a payment plan with the court? I called them up and I can ask for a deferrment but my court date was awhile ago and I have explained my present circumstances. Any help would be great thanks!

Post-dating a check doesn't do anything. It can be cashed the moment you sign it.

Call the court again, and explain the situation. If you can't get an answer, ask for a supervisor or an ombudsman. This is someone who's supposed to be the "go to" person when you have odd questions, among other things. Be persistent.

Better yet, go to the court now, pay the fine, and explain the situation to the clerk you pay. You may be OK, but don't count on it. They hear every sort of sob story you can imagine, and more that you wouldn't believe. They are not inclined to be sympathetic. If you have it, take the envelope with the post mark on it as proof that you got the notice late.

I would contact the prosecuting attorney personally. and be pushy to his office staff if you have to because they are trained to not let you see him around here but if you are persistant and polite you can still get in. do it BEFORE the court date or in this case the deadline. Don't wait til the day of because they will reject you.

If there isn't a postmark on the envelope then it didn't go thru the post office. Someone from the police station hand delivered it which is a federal offense.(tampering with mail). you need to seek out a good lawyer and investigate that part. try the ACLU. they are always looking for a fight.

I think they are trying to make you hire a lawyer and dump more money into the judicial system.

You should have post-dated your cheque.
