Peyote is a controlled substance, but native American have been using it in their rituals for millenia.
It falls under freedom of religion

It's constitutionally permissible to do anything as long as you can argue the fact under the supreme court and win. Native Americans have managed to do that with peyote. I'm just waiting for a citizen to challenge marijuana successfully.
