I have been employed with a hospital in full time status for over 90 days but not 90 days worked (about 70 actual working days). I work nights and worked the eve of thanksgiving at 11pm when their rules start to recieve holiday pay. I just got my check today and was paid only regular time for the holiday because I was full time. I called accounting today who said the problem was that I was clocking in under eduction and technically since I was under orientation status I will not be paid time and a half for the holiday. This employer is behind and we have to clock in by telephone, is it my fault b/c they gave me the wrong code to clock in under all of this time? Should I contact my labor board with this issue. What is the website or number for my area in Illinois?

Ummm you can try to contact someone, I think it is wrong cuz they gave you the wrong number to clock in under that could win your case right there...and go to your top person in your building unless that is the accountant, then i would proceed to follow up on your contacting a labor board...good luck and have a good day

I suggest that you visit www.dol.gov (you will also find contact information concerning the labor board in Illinois), look for the heading "General Information on the FLSA" or go to www.flsa.com (this site is hosted by a law firm). The Fair Labor Standards Act is very clear about who is entitled to overtime, what constitutes overtime and should clear up the many misconceptions about holiday and overtime pay. Once you have an understanding of the FLSA, you can talk to your employer and, hopefully, correct any problems. After reading your question several times and making a few assumptions, I believe that you are entitled to Holiday Pay at whatever rate was agreed upon (when you accept employment, a contract is created) by the employer (the hospital) and the employee (you). I am not sure on this one, but try the site below. This should help. Where I work, we are only given straight time for working the holiday.
