My mom and her husband has been living rent free in my aunt's mobile home. The relationship is abusive (verbally as far as I know) & she wants out & he refuses to leave. My aunt wants to file an eviction notice to make him leave legally but we don't know how to do it.
She let them move in rent free because they promised to help me with my bills 'cuz I moved out when she got remarried. He refuses to help me with my bills and he owes me $6000 & he refuses to pay it.
My questions are:
How do we file eviction papers?
File a restraining order?

She's afraid to leave 'cuz he has threatned to kill himself & their animals. She thinks that if she does leave, he'll try to hurt me or someone in our family. He keeps her from her family, she has no money, he doesn't work often & won't let her work.
So, she wants out but wants to stay in the mobile home (actually it belong's to my aunt's son). The plan is: kick him out & have my mom & her nephew live 2gether until she gets settled.

About the $...
When I was living with them, we were going to be kicked out 'cuz they couldn't make rent. So I gave them my Pell Grant money and he promised to pay it back. I gave around $2000.
Then I moved out a few months later or less. My grandfather soon died and he gave me his house and nearly $4000 to start off with. Well, I got the house and all the money was gone. No $4000.
So I'm out $6000.
I can't sue 'cuz I gave $2000 willing and the $4 was in a joint account with both my mom's & grandpa's name. The money was promised to me but she took it out legally (her name on account). It was grandpa's $ but her name was there sooo...
I'm screwed out of the $.
I really don't care though. Her freedom is work more than $6000 grand to me. Of course I want my money back but I want her out more.

The first thing you need to do is find an attorney licensed to practice law in your jurisdiction. Online, you can Google the Bar Association of your state, and find the link that brings you to an attorney directory. I assume you have internet access because of your question posted on the internet. Another option would be to try the Yellow Pages. Narrow down your search by looking for lawyers in the practice area of either family law or real estate (tennant/landlord) law. I'm sorry to hear about your situation, and I wish you the best.

Contact a family practice lawyer, and ask first for a restraining order to prevent him coming to the property. Then go to the Magistrates Court and ask how to set up a 30 day eviction notice. If there is violence involved, always call the police, so that you have a history of police reports should this ever get to court.

You own the employ till both a) the employ contract ends, or b) the eviction is done contained in the courts. one way or the different, the owner will assemble the money he's due. He can drag you into courtroom to carry jointly if needed. The courtroom will garnish your wages till the money is paid.

i know this sounds terrible, and it's a terrible situation, but your mom has to be the one to make this decision. she has to leave, if he threatens to kill himself, then let him. it is a terrible threat, but an effective one in trapping people (women especially) into abusive relationships. if you want, you can just type an eviction notice...but get your mom out. have your mom move in with you, then go to police station to get the restraining order. just explain to them that he is abusive. when everything settles down, then have her move in with the nephew
