My son is eighteen and his girlfriend is 16. They just had a daughter on November 8, 2006. Neither one of them have a clue about taking care of a baby. The baby lives with the mother and the maternal grandmother in a home with no heat and no hot water. They are using kerosene heaters to heat up the house. I confronted them about this situation and they got upset. Now they no longer allow my son or myself to see the baby. I have called child protective services, but so far nothing has been done. They also threatened to have my son locked for statutory rape if he continued to try to see the baby. How do I go about getting custody or should I even pursue it knowing my son may go to jail? Only serious answers please.

First I don't know what state you live in but in Missouri the age of someone being charges with statuatory rape is 19 and then only if the minor is under the age of 15. Go on line and check out your states law. Second I know it isn't what you want to hear but as long as they have some kind of heat in the house the social workers will look at it that they are providing. I know messed up but that is the way the system works, we went through this with my sister and she didn't even have food in the house but the worker informed my mother that as long as they got to eat two meals a day at school then they were being fed. You and your son need to contact an attorney. If his name is on the birth certificate then he just needs to file for visitation to the child to start if it isn't then he needs to establish paternity. It is important that BOTH of you are fighting to get rights to this child. You unfortunatly have no choice but to hire a lawyer and file for custody if you can not get social services to help you. At 16 the girl not knowing anything is normal but her mother should have a tad bit more sense than to try to raise a baby this way and to keep it away from family that loves it and wants to be a part of it's life is cruel, kids have a hard enough time without that. ALSO no matter if it is nothing but $25 a week your son needs to get a money order and start paying some support to show he is capable of supporting the child. It will protect him later if they hit him with an order because he will have proof he has paid some. Keep calling social services call them every day if you have to but get an attorney as well.

Do everything the legal way. And only do it if it's benefiting the child, you never want to do it just to get revenge or just to hurt the other parent. The young girl probably is only doing what she can afford to do. And they are seeing this as you hurting them.IF you feel as if she can be a great mom move her and the baby in,and sign both of them up for parenting classes. YOUR son should take on some responsibilities too. It sounds like both sets of grandparents are fighting too late, rules should have been set before these kids had babies. But don't punish the mother because she's young.

Where I'm from 16 is the age of consent. Go talk to a lawyer and he can tell you more. He can also tell you how to register a complaint against protective services for not doing their job.
