According to the Geneva Conventions aka the Rules of War, a uniform of some kind that distinguishes you from non-combatants is required. This is one of the reasons the Iraq War is so difficult. US Soldiers stick out like sore thumbs, but the insurgents blend right in with the civilians. For the US it's like a doctor figuring out who in a group of people has cancer just by looking at them.

Yes.

Under the Geneva Convention, if a combattant out of uniform alttacks you, you are allowed to return fire and kill him.

And unless he falls under the few clauses that would make him a prisonner of war, he is either a spy or an unlawful combattant, at which point he is subject to punishment under the laws of the land. If those laws include the death penalty, then yes.

Deserters, if captured, however fall under the Prisonners of War category and are to be afforded the same rights and privileges as any other soldier captured in the field.

Out of uniform or in enemy's uniform you are considered a spy and can be executed with caught.
Cowardness in the face of the enemy is a death penalty by firing squad.

Ummm... if they're attacking you, and not wearing a uniform, then yeah, you can.

Not sure why you wouldn't just hand them over to the guys in HUMINT instead, though... that would be a better move.

Remember there are no rules in war only winners and losers. The winners tell tell the losers what is right and wrong.

The rule is that you cannot fire unless` fired upon. Maybe that is why some military people get demoralized.

generally you can shoot non-uniformed soldiers as spy's, however i don't think this applies to militia.
