i was hit by a girl who has allstate insurance my vehicle is now totalled and i am left without a form of transportation as soon as i return the rental vehicle so my question is arent they responsible to make sure i have some sort of transportation as i am waiting for the money so i can get back too my schedule i have a rental and i have been told that theyare not responsible for it after the 22 of november this is the date they concluded that my vehicle was a total loss i havent recieved a check yet so i am not ready to just give up the rental car and start hitchhiking should i call a lawyer or talk to them first?

All depends if you signed for the insurance option on your rented vehicle.

Generally no, they would not be responsible. They tend to provide rental during waiting periods (probably the time until they declare the car a loss) or during certain maintenance. It would depend on your policy ultimately, as I guess you could have a clause of some sort stating they would give you unlimited rental. . .But you see, they have no way of knowing when you'll be purchasing a new car, which can be time consuming, so I can't picture any insurance company agreeing to that. And there isn't some law stating that they need to make sure you're provided with transportation. You may just need to pay for the rental (. . .perhaps a better option than your suggested hitchhiking. . .) Call the agency and talk to them; ask to see your policy, and specifically where it talks about rental cars. You'll know then for sure if you're getting what you've been paying for or not.

The insurance company is correct to cover rental vehicle expense until they determine your vehicle is a total loss.
It is time for you to go out and buy another vehicle. If you buy a used car, most of the time the car is ready and you can have it the day you pick it out.

Hiring a lawyer would be too costly. If you have rental vehicle coverage on your own policy, you can consider using your own insurance, then let your company collect from Allstate.
You can also consider contacting the claims manager for Allstate or the president of the company to tell them their adjuster is not being reasonable.

And what, you think the lawyer is magically going to be able to change a multi million dollar companies policy and "magically" keep you in a rental? Getting a lawyer would be a JOKE in this situation. You do realize how much more you would spend on a lawyer then a rental correct?

and btw... insurance companies are NOT scared when you threaten them with a lawyer. They get off the phone with you and laugh about it.

But, back to the rental. Technically, no, they dont need to keep you in a rental. It would be the nice thing for them to do until the check for a new vehicle is in your hands but- it sounds like their policy does not allow for that. Generally though, the second that check is in your hands... your outta luck.

I would suggest calmly calling your adjuster and asking if there was a way they could keep you in a rental only until the check for the total is in your possesion. be reasonable and do not get upset and yell.

Simple answer is no. They are not. If the person they represent was at fault, they have an obligation to make you whole for your loss, to either fix your car if feasible, or to give it's value, not to supply you with a car for an indefinite amount of time. During the time you had it you should have been making arrangements to get something else.
