my mother put a deposit down on a 1 week old puppy, within 24 hours she changed her mind, the puppy will not be ready until christmas, the owner will not refund her deposit, we have not signed a contract of sale but we have a reciept for the deposit. we let the owner know within the 24 hours. please can any one advise me on the next step. Thank you

Read through the contract, even though your mother has not signed it. Somewhere within the legal-ease, it should state the refund policy of deposits or in the event that the dog has health problems.

As long as the breeder informed you the deposit was non- refundable prior to making it.there is nothing you can do. the whole premise of deposits is to hold the pup. If the breeder took your deposit and someone offered him more money you would be upset if he didnt honor your deposit. One more reason people need to think before they buy or in this case try to buy. If your mom changed her mind in less than 24 hours then this was an impulse that was not thought out properly.

It is the landlord's burden to prove why withholding a security deposit is justified. The instant he said that you may only get part of it back was the time you should have asked, "Why?" Texas law is like everywhere else. A landlord may withhold deposit only when necessary to cover his actual damages, which would be the cost of cleaning, repairing damages, etc., necessary to bring the rental unit back to the same level it was when the tenancy began. I presume the security deposit is not addressed in your purchase contract. Perhaps you can negotiate for the security deposit to somehow be reflected in the amount of cash you bring to closing. If not, then you'll need to sue the landlord for return of your deposit.

A deposit is only non refundable if it is clearly stated. Did you get a receipt and dose it say no refund on it. If not take her to small claims court or call judge Judy

That receipt is a legal binding contract. This breeder is a qualified good reputable breeder? Or a back yard breeder?
Call up someone in your area, by law this is just like putting a deposit down on a TV or computer.....at least this has been my experience...
The money of course is in the breeders hands though. If it is more then what $300 small claims, good luck!

If you back out of a contract, even if the contract is an oral one, you loose your deposit.

THAT is why I don't take deposits. I would much rather someone don't get a puppy from me, if they change their mind, rather than buy one anyway just because they have given me a deposit.

As a breeder, I say it is wrong for the breeder to keep the deposit. The pups is only a week old, sop she has plenty of time to sell the pup. If it was me, I would give the deposit back without second thought.

Forget it. Clearly, you didn't put too much thought into the decision, if you changed your mind in lass than 24 hours!!!

Any time I take deposits, they are NOT refundable!!

The whole ***POINT*** of deposits is that they are NON-REFUNDABLE!!!
