I have a girl friend who was remove from the uk cause her refugee status expired in 2004. i love her and want to marry her. I am a german citizen resident in the uk. my question is what can i do form her to come back to join me in uk

Well if you love her and want to marry her...I suggest you either move to her country or go back to Germany where you might get a more sympathetic hearing!! Britain is FULL!!!!

Yes, but marriage is really the only way it can work. In theory other things are possible but, trust me, these are very, very unliklely to work.

You don't say where your girlfriend is but, wherever that might be, you need to go there, marry her and then support her in applying for a UK visa as the Dependant of an EEA National exercising residence rights in the UK under the Treaty of Rome 1957.

Getting her the visa may not be easy. Immigration are likely to be concerned that you have married only in order for your girlfriend to qualify for a UK visa. Try not to be upset about this - unfortunately this is a situation they see often and ' marriages of convenience ' are really very common. Give them no reason to believe this applies to you. It will help to show that you and your girlfriend were in a settled relationship in the UK before she left. Even better, if you lived together and can show them a joint lease or joint bills that would be excellent evidence. If not a photograph album of your lives together, even sworn statements of friends might help. Basically anything that shows that this was a genuine relationship which has ended in a love match marriage.

Getting the visa may also take time - the embassy are likely to request details of your girlfriend's immigration history from the UK. The whole process could easily take several weeks and there's a fair chance that they will want to interview both of you at the Embassy. It could all be quite difficult and inconvenient - possibly involving more than one trip abroad for you - but it should be worth it in the end. If these basic points are satisfied the visa should be granted :-

You are living and working in the UK ie you are a German national exercising your ' treaty rights ' in EU law ;

You have sufficient income to support and maintain your wife ;

There is no clear evidence that the marriage may be a 'sham' contracted for immigration purposes : if you can provide clear evidence that it is not they will have nowhere to go with this.

So, my friend, the question is are you and your girlfriend ready to be married ?

u need to go and speak to a lawyer, they would be able to give u the best advice. i have heard,that if u can prove that you have a life together, u may be able to go to her country and bring her back. i don't know how true it is but its worth looking into. otherwise think about moving to her country? if u love each other so much that would be another option.
but best thing is to seek legal advice...go to a lawyer.

You can marry her, she can go and live with you in Germany until she gets German documents and then with them she can come here in UK and live indefinitely without any problems.
But if she tries to come straight away to UK she won't succeed.

I'm sorry to say she is not welcomed back after deportation, so your best option is to get on a plane and go to her, and remember she's not allowed back so live in France or Germany.

I would think that if you marry her she becomes a European citizen and as such she can come to join you here. Take no notice of the likes of kbw.
