it is a violation of federal and state and local law in so many ways if you mkae and sell alcohol in any form fashion or way without licensing. It is called bbotleggin and you will go to jail becuase of health permit issues and taxes and such.

This may vary by state or other region, but I don't think you're allowed to sell homebrew, and you would need a liquor license to sell any kind of alcoholic beverage.
In California, you're allowed to brew a certain amount of beer and make wine for your own use.
