Actually the Japanese announced today they are in fact capable of building a nuclear weapon. They have many limits on their military capabilities, but they do have the technology should the need arise.
Considering N. Korea's recent actions, they just might break some of treaties they feel they need to, in order to protect themselves.

Article 9 of the Japanese constitution states that Japan forever renounces war and the use of force to settle international disputes. The present interpretation of article 9 is that it allows for self-defense, hence Japan has a self-defense force. This has been accepted as within Article 9 by the supreme court. Foreign minister Aso has recently suggested that if nuclear weapons were used for self-defense, then that would be compatible with Article 9. Probably, Aso's indentation when he speculates about the constitutionality of Japan possessing nuclear arms is to put pressure on China to put pressure on North Korea so Japan doesn't need said nuclear arms in the first place.

The Japanese constitution forbids an offensive military force and also prohibits nuclear weapons. However those parts of the Japanese constitution could be removed if Japan feels the need. The Japanese constitution also forbids foreign interventions thus the Japanese never send armed soldiers only medical and supply people to places like Iraq.

Simply speaking, article 9 prohibit preemptive-attack, but not military. JSDF,Japan Self-Defense Forces, is virtually a military.
And Japan Defense Agency, today, will be changed to Japan Defense Ministry next year.
As for nuke, there is "Three Non-Nuclear Principles" in Japan.
Even today, people have a strong resistance feeling against nuke.

Yes, that's true. Thinking the Japanese are unable or unwilling to acquire nukes is a mistake. Wonder how many nukes are on American subs off the coast of Japan just waiting for N. Korea to pull something? Japan doesn't need nukes given its strong alliance with the US.

They can only have military forces sufficient for the defence of their country and until Iraq were not allowed to operate outside of Japan. They cannot have nuclear weapons.
