ok, unfortunately this was done at an age where i would be able to obtain credit, question is, if it wasnt me who started this so called contract, is there a way where i could dispute it, either to pay a certain amount instead of paying for something that was done without my consent, and it being family, dont want charges all up in the mix........ does anyone have any supported info?? thank you for taking time in reading this.....

You can contact the creditor and settle the debt for less than what is owed, if the creditor is willing to negotiate with you.

You can also bring a civil suit against the creditor to demand they remove the debt from your report. This will avoid the criminal charges against your family member by mearly requiring the creditor to prove the debt is yours in court. Since it's not, they won't be able to prove it and a court will likely require it removed. The burden of proof will be on them - not you.

Really, if you get a lawsuit written by a lawyer and mail a copy to the creditor with a cover letter saying you intend on filing it in court, you will likely get them to cave to your demands without doing anything further. No one likes to go through the expense and headache of a lawsuit over something that is probably a very small dollar amount.

If this family member is willing to step up to the plate in your defense and make a payment arrangement with the people you now owe money to. They may hold this person responsible and not have charges In the "MIX" (lol). They would have to be willing to put it into wrighting so if he / she doesn't pay the debt they are held responsible because they have acknowleged on paper that it is their debt not yours. I'm not so sure the company itself won't press fraud charges. If you can talk to them yourselves and tell them what happened without giving any of your family members names they might work something out just to be able to get their money. This is all providing this family member feels bad enough to accept responsibility. If not than you gotta do what you gotta do even if this means taking legal action against this person because it can truly hurt you later I know I'm having a hard time buying a house right now for the same thing. Are you fixing credit or owe?

To simplify your options are.........

-if it's just fixing and you don't want charges, deal with it and repair your credit
-if you owe family member realizes that he/she would be charged with what is a federal offence. Once that ball starts rolling there is no stopping the road to real jail. They start paying it off.
-you realize this directly effects your life and even to the extent on getting a good job..... decent employers do credit checks. It will take years of effort to completely erase this. The family will recover and realize you did what you had to do
-you get this person charged, you don't show in court. They will have to go through the years to clear it.

Bottom line... take care of you. We all have family that does stupid things but in the end it is you that matters.

You have 2 choices. Live with it and pay off the debt. Or file crimminal charges and clear your good name. Only you can decide which way to go.

But if it were me, I'd be filing charges; family be damned. They thought less than that about you when they did it! If you don't you are sending the message that it's OK to take advantage of you. You are an enabler! Like buying booze for an alcoholic.

But it's YOUR life!

If this was done without your consent...it is considered to be FRAUD. If you continue to word it that way, you will have problems. The credit companies may request that you file a fraud affidavit form.

If you want to keep it on the down low and settle out your accounts for a lessor amount you can do so.

According to Dave Ramsey and others, Idenity Theft is usually a close family member or friend.
In most cases, a police report would be required to clear it.

Dave says in a newspaper column that you may not owe the money. I do know that may be a battle to prove to the company making the claim against you.

well, sadly no, if someone used your identity for a financial transaction without your ok, you either have to file a report that your ID was stolen, and it will be investigated, so that it can be resolved, but that person could face charges, or you can say nothing, and the debt is your own. You can either beg the person to pay up, or perhaps you can take them to small claims court

amazingly,i deal with this daily,first you need to file charges,(if known who did it?). whether it be family,friend.go to the police department,and file charges,against them. Next step,if its gone along this far,its probably with a collections company,mail their initial letter back with a dispute,also, id provide your number to contact you at,also what times convinent. Lastly, Id take care of the balance,best of your ability,or it appears as a negative item on YOUR credit,not on whos responsible. certain, xbox tries to screw human beings continuously. i wish you may want to sue them and take each and every thing they have. is ridiculousness that there continuously appears to be like an blunders at the same time as attempting to cancel your account. this occurred to me and that i referred to as my economic employer and flat out instructed them to no longer enable them fee my account. i have been given a decision from microsoft about 2 months later and they the position complaining that they couldent bill me for the gold service and that i have been given in a strive against with him because i instructed him its loopy i could not cancel it and besides your service isn't a use and bill me later service. at the same time as i change into authorizing u to fee my card you charged me then gave me the service. and they instructed me i had a bill of like $60 and that i havent even had a crapbox for over 2 years so i instructed them im no longer lifting the ban and to screw off and that i hung up... they havent referred to as me decrease back and its happening the third month and they havent charged me.
