Have you ever been audited for tax fraud? what was the outcome? I am talking about fraud on individual taxes. Please tell me what happend to you.

Well not fraud, but I have been "negotiating" with the IRS for a long time and I do know a few things. First, like anything potentially criminal, always have somebody else speak for you. For any type of fraud they have to prove you KNEW you were intentionally misleading them. This can be very difficult. BUT they way they will get you is if you change your story from one interview to the next. SO, if you are not sure it is best to just say you do not recall rather than try to force a memory. Or the files were not kept, or were lost. I am not saying go and lose things, that is just more trouble. But I am saying if you are not 100% sure what was in there and why, then just say I do not recall for sure. If you try to recreate memories of things you'll change answers even slightly from time to time and you will appear guilty. Good luck. Tell the truth if you remember it, but don't try to force anything.

The IRS has the burden of proof to show fraud. You don't indicate whether this is civil or criminal. If the agent reads you the standard Miranda warning, make like a Trappist monk and be silent. Then assert both your right to remain silent and your right to counsel. This CANNOT be held against, no matter what the agent might say. Then get a good tax lawyer. FAST. If it is a civil matter, they still need your statement to show fraud, you just can't refuse to answer questions. There will be detailed inquiries. You need help and an accountant is not good enough as there is not accountant--client privilege. Your attorney has to hire the accountant to keep communications privileged.

whoa, talk about a royal pain in the butt. if this is going on with you, i feel your pain:(( four or five years ago i went to the same tax preparer that i have used for years, i have always dealt with the owner and everything always turned out right, well that year
she let one of her asst. take care of me (i had a wife who had a child and i was claiming him on my taxes because they lived with me as head of household). and she didn't fill out the form to give the mother(my wife) the permission to claim him. i can't begin
to express the mortal heck i went through for the next FOUR freaking years trying to fix it. finally one day, and it was a beautiful
day, the i.r.s. auditor called and who should answer the phone?
it was my step-son. the guy asked for me as i was out of the house at the time and then asked who was he talking to and my step-son said his name, then he asked if his mom's there and she picked up the phone, he asked her was this the (my name)
address? and she replied that not only was it our address, but that was her son that i have been taking care of for the past several years (she does not, or hasn't.t had a job since i married her) as well as her. then he said this case has now been resolved
and i got a four grand plus check in three weeks.
