i am being constantly harrassed by this company even tho i dont owe them a penny it is for a debt with the nat west bank which i have never been part of and was made 3 years ago , i was only 17 and wouldnt have got credit anyway .They dont seem to understand this they phone every nite they swear and call me a liar i have lost my rag with these people and not sure wot to do about them ,i already made complaints to trading standards and others but no change ????????????

must add tho have learned a few things whilst tryin to sort it out , baliffs cant be used in scotland untill u have been taken to court and defaulted on a ccj , and have checked they are a real company but as far as i can tell u couldnt call them reputable

Next time they call, take the bailiffs name, and ask which court they are registered with. It is to that court you'd have to complain about the conduct of the bailiff.

Bailiffs are required to lodge a security bond with the court, and acting beyond their powers will cause the bond to become forfeit: if my memory serves me correctly, it is £10k.

Keep a record of the calls, what is said, and whether they say they record their calls: it will aid your complaint.

Meanwhile, you need to get the details of the supposed debt from them, and contact Natwest. The bailiffs will keep trying to collect until they are told the money isn't owed by Natwest. Capquest is part of the Capquest Group, and they will have bought the debt from Natwest, and so you need Natwest to confirm that the debt doesnt exist.

Its complicated and a pain, but the best I can suggest.

I had exactly the same problem. They are a nightmare and call every day and don't listen to what you say to them. I said I wanted proof of the debt I owed and they couldn't supply it. After telling them this every day for 2 months they then said OK we'll go back to Natwest and get back to you - 2 months later they haven't got back to me but the calls have stopped so I'm not bothered. Threaten them with legal action for harrassment and say you've spoken to a solicitor and until they can prove the debt you don't want to have any more calls. Persevere it does work. What surprises me is how they can take on a debt to chase without knowing anything about it. Natwest are bunch of idiots as well.

You don't need to worry about bailiffs unless it goes to court and you don't do anything about it. I told them to put me in court so I could dispute it but they didn't beause they can't substantiate it. Stick to your guns and fight back.

As part of my job i have dealt with this company and suggest that (unless you have already done so) you visit your Citizen Advice Bureau. Also, can Nat West provide details of said bank account? if not they should be able to confirm that you were not their customer. Block your 'phone to their calls, return any post unopened. You could also contact a banking ombudsman or a consumer magazine or TV programme. Good Luck

Have you checked them out...are they a genuine company??? Ask for names and to speak to a manager. If it persists tell them that you are talking with your parents solicitor and have reported them to the police for harassment. Call their bluff. Go to citizens advice. Call your telephone provider to see if they can block calls for you.
