I have a Chinese friend who came to the US about 9 years ago. He has lived in an apartment the whole time and gone to school. The problem is his family lied to the government about the reason he needed to come here and never left when the time expired.

Since he's been here for over 9 years, isn't he granted immunity? I remember watching something on the news that illegal immigrants who have been here longer than 4 years can apply for legal citizenship without having to worry about deportation. Another problem is that his parents don't speak english but their son speaks it perfectly.

Here's the deal. Almost anyone who is currently in the US illegally can ask for and receive permission to legalize his status and apply for citizenship. This will take months and months to process but he is allowed to freely live in the US during the process.

This is complicated to do but mostly in terms of the various forms to fill out, who you go see and the fact that he needs a hearing with immigration official. What this basically means is that he needs to hire an immigration lawyer. Note that everything he discusses with the lawyer is protected by attorney/client privilege. It's a very common thing to do and well within the abilities of a competent immigration attorney.

Until he does this, he is very vulnerable to being deported. Not saying people will deport him if he is discovered because in many municipalities they will not (even though this is against the law). But, they have the right to. Once he begins this process, they no longer have the right to. Once his status is normalized, he is no longer a criminal fugitive. Citizenship will be his eventually. Just not in a timely manner.

I think you may have misunderstood or heard wrong. There has been no law passed saying that illegal immigrants who have been here for longer than 4 years won't be deported. There is some talk of granting amnesty to people who have been here for a long time, but it hasn't happened.

And considering that they lied in the first place, and then overstayed their visas, their chance of getting citizenship isn't good.

Immunity? Absolutely not. He can be deported for (a)Lying on the original entry papers and (b)over-staying his visa. Odds are, (c) he is not a student anymore either.

The Feds might be reluctant to deport because it is Communist China, but he has no right to be here anymore, and the Feds have deported moms who had similar circumstances and had children and jobs for longer than 9 years.

I don't know why his family felt like they needed to lie to the government. I believe the US takes in refugees from China since it's a communist country.

If he is returned to China, he WILL be executed without exception. He can plea to the US for asylum, which is what his family should have done to begin with.

If he's denied asylum with the US, he should try to get into Canada.

And, above all, seek God in this matter. God can unlock doors that no human can.

Well, I would talk to a legal immigration lawyer for my friend so just in case you're wrong, he won't get deported.

Dont worry, i'm having immigration problems too.
