Here's the deal my lisence is suspended to not paying tickets, and my friend was going to drive home drunk from the bar but I went to pick her up. I took her car cause my lisence plate would of told that I had a suspended lisence. So we ended up getting pulled over and the cop said it was because her temperary tag was not visable, but it was in the rear window withing plain sight. Anyways he ran my lisence and gave me a ticket for driving while lisence suspended. Then he let me drive home which makes no sence to me at all. Anyways I have photo's of where her temparary plate is which in my eyes proves that there was no probable cause for the initial stop. What should I do and what should I expect to happen??

i really do not think those pictures will matter because there will be a chance the judge or magistrate will think they were fooled around with so no luck there.... If this is your first offense you are prolly looking at a fine plus court costs and maybe some community service no sweat pay your fines and do the service...

You can certainly challenge the probable cause, but you will likely not win that battle. In most states cops are absolute EXPERTS on all the ways to pull you over. I know... I have been doing it for 11 years. The license plate or temporary tag in the rear window won't cut it here in CA. The officer's testimony that the plate was not visible (because) it was in the rear window will probably be enough to justify the stop. Once he has you stopped, and even if he then sees the plate in the window, he can still ID you and check your authority to drive. That makes the suspended DL charge solid.

In California driving with a suspended DL is a misdemeanor that results in substantial fines and even jail time.

Thats a toughie. first of all why did you even drive to pick her up knowing very well that you had a suspended lisence? what you can expect from that is a court data to get the ticket paid off and you will probly will get into some trouble for driving with a suspended liscens. as for the officer letting you diver home your very lucky that he didn't hook you for that.

It depends on state law, but most will just give you a fine that you have to pay. Usually it is just a ticket, but sometimes you may have to appear in court to resolve it. It is a judgment call on whether the temporary tag was in plain view, so that may be a losing argument.

Depends on your state and the reason for a suspended license. My friend has a suspended license for a DUI conviction... if/when she gets caught she will go to jail for 6 months.
