Ok, so my husband abused my grandson for awhile. It got so bad, my grandson attempted to commit suicide. But I got a message from the husband (now my ex) saying the police were going to make him move back in with us! HELP

The police cannot force you to take someone into your home unless they have a court order from a judge. Young children (under 18) are the exception to this, you can't just kick them out. The police can make you take them back, by law parents/guardians are required to shelter, feed, and care for minors unless there is a court proceeding to sever parental/guardian rights and responsibilities.

As for your Ex... Both of you would have had to go to court, your lawyer would have built a case to keep him out, and his lawyer would have built a case to let him in. If his side won the court would have issued official paperwork delivered to the local police force. Officers would be there to make sure you let him in to enforce the judge's ruling. You would have to let him stay as long as the ruling stands. If none of the court stuff happened, then your Ex if full of s***.

Take a good look at the paperwork for your home.
--- If his name is on it as one of the owners/renters then he has a legal right to be there and you have to let him stay.
--- If his name is the ONLY name listed as the owner/renter it's actually his home and he can kick you out or have the police remove you if you won't go willingly.
--- If BOTH of your names are listed as the owners/renters then both can legally stay and neither of you can kick the other out.
--- If his name is NOT listed as an owner/renter he has no right to be there and if he tries to get in, call the police and have him brought up on Breaking & Entering/Home Invasion charges.
--- If NEITHER of your names are on the paperwork, because you live with someone else. Then only the person listed as the owner/renter can say who stays and who goes.

Since he's already demonstrated a tendency for violence toward your grandchild, you may want to take precautions in case you think he might try to attack you or break in. If you think that this is the case, you should visit your local police station and speak to one of the officers, tell them about your situation and ask how you would go about getting a restraining order, in case you need one.

Before you walk away from them give them a piece of paper and have them write the following:
--- The current date at the time of your conversation.
--- His or her name clearly printed.
--- His of her badge number.
--- His or her signature

This could be very important for any future court case, so keep it safe and remember where you put it. It could be necessary to establish when you started feeling your Ex-husband was a potential threat. This piece of paper now provides you with an accurate written record and a witness for this purpose. The officer will have a better chance to recall the conversation and remember the unusual request to write and sign this note.

Why the heck would the police make him move back in with you? He's your EX, right? I think he is lying to you. Don't believe him, and don't talk to him. Protect your grandson and take care of him. Support your grandson emotionally and tell him that you will protect him against your ex at any cost. Don't let your ex move back in! He's lying to you! The police would not make or force anybody to move back in with somebody that he was abusing. Tell your ex to get a life and stay away from you and your family.

Candy: The police do not place a person back into their former home ex or not. He is doing a con job on you. Your grandson doesn't need that perverted jerk around him. Call the cops and inform them on your ex husband's attempt to lie his way back into your home and life. He is a criminal and it is illegal for him to attempt or be near your grandson or even, you so, he can have access to your grandson. Throw him in the slammer [jail] where the low-life deserves to be. TAKE THIS SERIOUSLY AND CALL THE COPS !!!

I'm sure with a court ordered restraining order due to the abuse you can protect your grandson and keep him away from your ex., and get him to counseling as soon as possible so the suiside attempt will not reoccure Good Luck and God Bless

I hardly believe the police would even think of that, they don't have that kind of power not even a judge can tell a person who they have to live with. I think your ex is blowing wind and hoping your stupid or gullible enough to believe what he's saying. Put a restraining order against him, that'll shut him up because he won't be allowed to contact you in any way, not even through another person.

Ummmm, NO!!!

You may want to get a court order to keep him away. Police cannot make you take him back in. It can only be court ordered and I don't think any judge in his right mind would do that. You may want to talk to the police for yourself and possibly a lawyer. I think you have rights you don't know about.

He is lying to you. The police and especially child protective services would never allow him to be near the child,so no way they would MAKE him move back in. QUIT talking to him, and having contact with him,he just wants to upset you.

Whoa - did you get a restraining order or take any legal action in this matter? If so you should check with your lawyer. If not get a lawyer.
