My dad going throught an intersection (yellow light as he told me) and the other car made a left turn, he hit that car on the rear passenger side. After that he stopped and step out of the car, he saw the other driver waving in the air so my Dad thought the other driver tell him to go (my Dad couldn't speak good English and he was scared so he fled away). My Dad reported to the insurance company after that, and the next day we got a phone call from the police that the other driver reported my Dad passed the red light and Hit & Run (the other driver has a wittness). We just got the police report with Hit and Run felony (Code 20002) and a court apointment. Could anyone tell me what is the charge for my Dad and do we need to hire an attorney or contact the other driver to settle down the lawsuit? Our insurance company will pay for the damage, I just don't want anything happen to my dad.
Pls help, I really appreciate that. Thanks

the charge i suspect is pretty serious. Fleeing the scene of an accident is a very serious crime. I like the other guys answer of getting a lawyer, and you can maybe minimize the charges. Good luck.

Oh yah, your dad needs an attorney that handles this kind of situation because a hit and run is a felony that can end up in prison. If your dad is convicted, your insurance doesn't have to pay anything and your dad will be stuck with the bill. Meaning the other person will sue your dad not the insurance company. Your dad should have stayed. An accident is much better than a criminal felony. Crappy deal.

The charge is Felony Hit and Run -- right there on the police report!

Yeah, you need to hire an attorney! Pronto! That carries prison time.

You'll also need another attorney to defend the lawsuit that is most certainly coming.

Deal with your attorney and your insurance company. Do NOT contact the other driver directly! If you are prepared to make a settlement offer, have your attorney do that.

G'day Nate,

Thank you for your question.

It depends on the jurisdiction but Felony Hit and Run is the charge. It is a fairly serious charge which will lead to loss of license and possible imprisonment although the fact that it was not a fatal accident will reduce the seriousness. I would speak to a lawyer, preferably one with experience of motor laws in your jurisdiction.

I would also work on getting references from people as to what a solid citizen your Dad is. It could come in handy.

Regards

The can charge is "leaving the scene of an accident". whether it would value some hundred money, i'd propose a minimum of, having an criminal expert assessment the case until eventually now your father is going to courtroom, to propose him as to what he can anticipate. it particularly is going to likely be money properly spent. criminal costs are severe. An criminal expert are able to have the can charge decreased to a misdemeanor (because of the fact your father DID call the coverage company), which includes lesser fines. luckily, there have been no injuries, which would be considered. Your father's automobile coverage rates are certainly going to enhance because of this incident. confirm he's accustomed to that he could in no way go away the scene of any accident while not having a police document taken, no rely if it particularly is his fault or no longer. solid luck.

Were there any witnesses? Were you in the car? Unfortunately, people sometimes want the insurance to pay for their "injuries" when there were none.

Your Dad should not have left the scene of the accident.

You need to get your Dad a very good lawyer.

@ hit and run is still a hit and run whether anyone is hurt or not. It is still a felony. I would get an attorny, esp if your father can't speak english well. Make sure you have an interpreter @ court as well. Make sure he tells them that he thought they were waving him on. He might be able to make a settlement.

ask your insurance company but if your father was going strait and the other guy turned in front of him then it seems that the other guy made an unsafe turn because when turning left you must yeild to on comming traffic which sounds like thats what happened

well unfortunately since he fled the sene of an accident he really dosen't have a say in it. yes i would get an attorney and see what they think and let them get in contact with the other people and talk to them to see if you all could settle all of this.

You are going to need a lawyer and a good one at that.
