Let's say you're on a road that has a median and you are in the left hand turn lane in the median trying to make a u-turn (it is ok to make a u-turn here). There is a car right across from you (if you were turning left they would be where you would turn into) and this car is turning right. So you are both watching the same traffic waiting for your chance to go and you are not watching each other. If you go at the same time and hit each other, whose fault is that?

If you are in the middle lane ( and it is ok to make a U-turn) then you have the right of way. You are still considered oncoming traffic to them and they have to yeild to you. This is the same as if you were trying to turn into wherever they were coming out of and they were making a left hand turn, they have to wait for you to make your move before they come out. Does this make sense?

Was there a traffic signal light in the intersection? A stop sign?
U turns are illegal in signal controlled intersections, where no u turn signs are posted, and where you cross a double yellow line and interrupt the flow of traffic.
If there was a traffic light and the person turning right knew the law, they would expect you to make only a left turn. The u turn would be illegal, and the person making the u turn would be at fault.
If there was no signal in the intersection then the u turn would be legal. Both parties not paying attention to the other means they both were at fault and hence would share the blame 50/50.
But if there was no signal and the person turning right had a stop sign then the person turning right would have disobeyed the sign and they would be at fault.
I am not a judge or lawyer but I am a commercial driver and this is the law as I understand it in BC Canada. The law where you live may be different.

The person making the U-turn should only do so, if it is clear. You would have to yield to all turning traffic coming from the opposite way....

I think that the two vehicles are equally at fault. For the simple purpose that neither one of you were paying attention to each other. I believe that if a police officer were to issue citations, that he would issue them to both parties. By the way your picture is hot.

Whoever started the turn first had the right of way. The other person is at fault.

Nobody is at fault because the two of you are doing the same thing. Thus, the remedy is that both of you have to repair the damages with your respective money.
