hey right now my husbands doing time in a state prison it sucks but about your friend if they have where they can work day for 2 days then he wont be surving the full sentence although there is a such thing as a judicial release basically he has to serve 30 days in state prison no jail no correctional facility he has to be in prison for the 30 days then his lawyer can file a judicial release but that means he could be on parole for like 5 years,or house arrest.Most of the time at least where my hubby is the judge is a ***** and on top of that a dyke so shes pretty hard on men and hasnt gave a judicial in like 10 years although we filed i even wrote a letter to the judge but did me know good im sorry to hear about your friend i know it sucks but if they did the crime they will do the time but i would check into the judicial realease what was the charge anyways casue that also plays a big part if he is harmful the society they wont even consider it until a parole hearing has come up and about appealing it you better have damn good evidence as to why he shouldnt be there and be able to prove his innocence cause if you appeal it and the judge still finds him guilty they can up his time it all depends on the judge i hope my advice helps you good luck and tell your friend to hang in there it will go by fast is it there first time being incarcerated i know my husbands not going back he dont belong in there hes not no convict well he is now but hes nothing like the people there murders,child molesters **** like that thats sad he got caught with a stolen 4wheeler and got 6 months but the good thing about it he gets out on my b-day jan. 15th i cant wait ok well good luck

he will being doing a lot MORE than just his time or maybe I should say getting alot more (whether he wants it or not) aqnyway most courts give you a day for a day off your sentence (means you get a day off of your sentence for every day you serve in county ) then when you go on shipment to the pen your sentence is automatically cut in half when you set foot in the state pen and are given your mittimus. (which is a warrant of commitment to prison and has your handed down sentence figured plus your projected "out date") after all the subtracted time as a hard copy document it also give you another 30 days good time knocked off the original sentence, so it ends up a 2 year bit serves about 6 months to 9 months this all in the state where I live. oh and a fact is NO ONE appeals a 2 year sentence cause you will be out before that appeal even comes up to be heard

there is a difference between jail and prison, if he was sent to prison, most states apply the 85% rule - must serve that amount of time of his sentence BUT, because of prison overcrowding all over the US, good behavior might allow an early release - also depends if he is a first time offender or not - it sounds like possession huh?

That depends if he appeals his case? He has already served a month, so you can take that off the total time.
Generally what the judge says goes. If he wants to go throught the appeals process and fight for a shorter sentance he can, but he runs the risk off pissing off the judge and getting longer time. They can do that.

OK, what did he do? Is this his first time or is he a repeat offender? What has his conduct been like to date while incarcerated? Sorry, impossible to say without more info. The only thing I know for sure is he won't be home for Christmas this year.
