Any instrument that can cause death or serious physical injury can be considered a weapon....for instance, a pen can be used for writing a letter, but it can also be used to stab someone. The pen is not a deadly weapon in itself. A baseball bat is an instrument for sports but swing it at someones head and in becomes a weapon. A car is a weapon when it is used as such.

If the cop is a well-trained gun handler and draws his sidearm and begins firing when the car is 25 yards (75 feet) away, he can probably get off four shots before he's hit. In that rapid fire situation, he won't connect with more than one or two shots at best. His pistol probably won't kill the subject instantly and definitely won't stop the car. Yes, the car is a lethal weapon.

You tap a cop car at 2 miles an hour (with the cop inside) and you're gonna be surrounded by police vehicles very quickly. Every encounter of this type is treated as an assault on a police officer. They only ask questions later.

With no other details, I would fire on the vehicle. If it just hit me and then hit my car, and I'm in a uniform, it's game time. Although 25mph may seem slow, ever see the damage it can cause? I look at it from this perspective. There was recently an officer sitting at a red light, minding his own business as he just completed training and was driving home, and the car next to him opened fire and killed him. The suspect stated he just felt like killing a cop. Why wouldn't I think the same in the situation described?

I would consider a car travelling at 5mph a lethal weapon.
I know of an officer that lost his leg because he was standing at the rear of his vehicle when it was hit at 5mph by another vehicle.

If it were accidental then there is no bounds for firing a weapon, but when they start moving the vehicle after hitting a person, a vehicle and then stopping just to move and hit a vehicle again... That is a lethal weapon.

If you wreck into ANY person or vehicle you don't start driving and wreck into the same vehicle again.
