happened in a fast food drive thru after bar.Could not order because other cars too loud. Walked back to other cars and asked if they could quiet down and even offered to buy their food when 2 women jumped me. After fight, I sat in the drivers seat to stop my friend, who wanted to leave, from driving away & I was injured. Police arrive and request me to move car from drivethru (thats the only time I drove) Paramedics arrive and strap me to a gurney causing a claustrophobic panic attack.Cop gives 3 breath tests in the ambulance 0.07-0.08. At ER I am threatened with arrest & "I spend the night on a cold concrete floor all weekend which won't help my injured neck" if I dont submit to blood test.I ask for my attorney but denied.At 4 am, I am cited out for a DUI and leave hospital to go home. Never went to jail, never handcuffed (thank God!), and never read Miranda rights.Officer did not charge other women with assault/battery because they said I started it. I'm permanently injured.

You were in the driver's seat and you did drive the car. If you had been drinking, you should have refused to drive the car. They didn't have to read Miranda rights because they didn't arrest you. Also, didn't have to provide an attorney because your were not arrested. You need to talk to an attorney about fighting the DUI.

You could have avoided the whole thing by leaving the drive thru and going to another restaurant.

1. You were a drunken idiot who started a fight in a drive through (cut the BS, yes you did)
2. You admit you drove, with the police standing there watching. Idiot.
3. You weren't under arrest so you don't get an attorney
4. Bull you're permanently injured, but even if you were you only have yourself to blame, you drunken idiot.

Ok, lets start with Miranda, no they don't have to read it to you, unless they are going to question you, ( the breath or blood test is not questioning)

So they can handcuff you, send you to county jail and never read the Miranda rights ( I know you did not got to jail)

And no you went to the hospital, and by the time you got out, your blood level would have been lower, and they issued you a ticket, ( that is allowed, no requirments to put you in jail)

Officer did not have to charge the other women, esp if they though because of your drinking you were to blame.

Ok, you were drunk, you caused a scene getting out of your car, and you got caught,

this is called making alot of mistakes while drunk and having to pay for them.

Okay, first YOU approached the other women--so yes, I can see why they would say you started it. I'm guessing you were drunk, so probably not exactly being friendly and polite when you asked them to be quiet. If the cops found you in the driver seat, then they would assume you had been driving. Cops can only go with the evidence they have--are they going to believe the drunken pleas of someone who says they weren't driving? Probably not. What of your friend--did they back up your story?
