The officer was missing his brown hat with the purple band on it the entire time he was dealing with me.
I hope to get the case dismissed because he was out of uniform... anyone else had this done before?

@ abby,
NY police cannot pull you over in just plain clothes. They have to be in uniform... they can't pull you over in unmarked cars either.

This is not totally True....
First Off, you cannot get your ticket "dismissed" because the trooper was not wearing his hat....I am sorry, you will look like a Dummy if you mention that to the Judge
Second, By order of Gov Pataki, NY State Police cannot cunduct Car Stops in Unmarked vehicles on State parkways while enforcing traffic violations.....It does not say anything about "Crime/Investigatory Carstopes" conducted by "NY State Trooper assigned as "Criminal Investigators"

I have no clue where you got the idea that a law enforcement person has to be in ANY uniform (full or otherwise) to issue a ticket. If you go into court and try to get your case dismissed on the basis of THIS nonsense, not only will you have to pay the full fine, but you will probably piss off the judge for being insolent and snarky. Not a good idea.

No they do not have to have thier hats on, it will not void your ticket. This is a myth about the hat, in varoius weather they don't wear them.
And actually a unmarked car can stop you, but they can not be assigned to work traffic.

Sorry, you'll need to come up with another lame excuse to get out of the ticket. You could still try it though. I'm sure the judge could use a good chuckle.

Full uniform does not include the hat. The hat is optional and may vary due to weather etc--baseball type hat, etc. Sorry--pay your ticket.

No, that has nothing to do with it, they can be in plain clothes and give you a ticket. as in plain clothes detectives so people do not know they are police. All of them can write tickets
