Here's the deal, my sister has a child and the baby's dad pays her child support (not by court order), but whenever he takes the baby with him he doesn't gives her a cent, is that the way it should be, or is he suppose to pay her even when he keeps the baby?

I think it's fair that is he's keeping the baby, he's taking care of her so he shouldn't have to pay.

Let me tell you something from the voice of experience: GET A COURT ORDERED CHILD SUPPORT ORDER!! Don't walk, run to the nearest court house and get it done. Yes he is suppose to pay child support when he has the child too. Also, make sure she has sole custody of the child. He will use this as a bargaining tool whenever it is convenience for him. Remember the child support is just that, its for the CHILD. So make sure you get this taken care of PDQ! Good Luck!!

The best thing your sister can do is to go ahead and work something out with the courts. It is the best way to keep questions like these from popping up. It would benefit everyone involved in that way. It doesnt have to be done in a vengeful manner. It is just a way to set certainty in boundaries and can help to keep the peace. If he doesn't want to do it that way then maybe some mediation between the two of them for the sake of the baby would help him understand. Otherwise, if she doesnt have it in writing there isnt much she can do.

if she has sole custody of the child (sounds like she does b/c the child lives with her and visits the other parent) then he is reponsible for child support regardless of the amount of time he spends with the child. child support covers the costs of the child's food, housing, clothing, etc. and doesn't mean that he is exempted from paying her money if he takes the child for a few days; he is responsible for the overall welfare of the child at all times. if they have dual custody then it might be different however child support is still necessary but may be in smaller amounts. you should contact your local children's administration office to find out what your rights are even if you have not settled this in court.

Does it really matter, he sounds like a sound guy, not many men would pay support with out being taken to court.
I am sure while he has his daughter its fair that he has that money, well that's my thinking anyway

No if he has the baby why would he have to give her money.
