I am a Canadian citizen w/ US residency; I am married to an American, we live in the US and had a baby 3 months ago. I do not plan to become a US citizen myself. How do I apply for Canadian citizenship for baby? Also, would there be any reason I wouldn't want to apply for Canadian citizenship (eg would baby lose his US citizenship?)

Hi there! It looks like you may have a few questions and in the end you're going to need people who have gone through this or are going through this to help. I believe your baby can have a Canadian citizenship as well as the dual thing works well for children of Canadian/American parents. Yes, the baby loses Canadian citizenship once adopted by American parents. I do not think that this law will restore those rights given that the parents have actually changed. "Under Bill C-37, however, had their children been born outside of Canada to them at a time that they should have still been a Canadian, their children now will also become Canadian citizens." The child would have been Canadian at birth, but after adoption, the parents would have applied and been granted American citizenship for their child. I think you had to wait until the child was 3 up until the 90s. This is not just a matter of changed residency, but changed parents. If this situation applies to you and you are now or wanting to go to Canada permanently, I would ask the government about how to request an exemption.

The only way for the child to obtain Canadian citizenship was if it was born in Canada.

Or, later on, go through all the hoops of the immigration process.

The same holds true for the other way around, of course ... to be American, must be born in USA.

If the child holds Canadian citizenship ... not much difficulty now, but look where tax rules are heading. If you hold citizenship in Canada (whether you live there or not), the Canadian government is going to (eventually) want to tax you as a Canadian citizen ... presumably to fund the Canada pension plan and the medical program, etc. Regardless of whether you're ALREADY paying US taxes or not. And, being from Canada, you know how different ~ that ~ can be!

Baby cannot "lose" his citizenship. If born in USA, then American. Must apply for Canadian as any other immigrant. If born in Canada, then Canadian and must apply for US as immigrant. You don't (yet!) have to give up one to obtain the other.

ok, your baby being born in US is American, yes you can apply for Canadian citizenship & the baby will not loose US citizenship
but rather have dual citizenship in Canada. Canadian citizenship takes a couple years but it can be done.
