I am from texas and i have recently found out that i have a 3 month old boy. the mother didnt think it was mine and now my boy has the last name of her ex boyfriend. well we have found out that the kid is mine but she will not cooperate with me in changing the name, i am going to be my sons father one way or another and i want my son to have my last name or at least have hers, not the name of some other guy that has never even seen my son. if someone can help me please give me some answers thanks!

Contact an adoption lawyer or the courts. I think you can change his name only if the mother and father agree.

#1 DNA testing will prove who is or not the father of the child. This becomes a legal issue and you can go to court to have the father's name changed on the birth certificate. The mother has the right to use her last name or the father's last name for the child. This is a issue that you and the mother of the child would have to discuss.
Think of the child when he gowns up, how is he going to feel in school about himself? Love, love is the answer and not war over who's wants what.

Do you want to care for the kid, or are you marking your territory? This is something important to think about. Unless you actually want to care for and be a positive father, try to get partial custody if you want by hiring a lawyer. If the mother has established a family, is it really necessary to disrupt it? Is this important enough to cart the kid back and forth between homes? This isn't for your needs, it's for the baby's needs, remember that before making decisions.

Unless she does this and the other guy signs off as the father you are up a creek with out a paddle unless you and her take the DNA to court and prove you are the natural father there is not much you can do.
