If his non Cuban wife and kids are Cuban citizens then I think they will be granted legal status.

Wow that is a good question... much food for thought.....I would assume that he would have a right to apply for them.... now getting this off the island would be a totally different story.....I wonder how long a person would be separated from his family while awaiting the process

When he gets here, he will ask for political asylum. After a certain time, he gets the permanent status if he "behaves well". The family will come when he filed a petition and gets it approved, is always approved.

If they came from cuba, yes, as long as they can prove citizenship of cuba, If they are a citizen of a different country, then he has to petition for family unity.
