I was involved in a car accident last Tues. I didn't call the police because I didn't want the kid to get even more scared. So I just took his number bacause he offered to pay out of pocket. Now his parents want to go through their insurance company, but no one will cal lme back.

First step is to contact the police department where the accident happened. They can still write up a police report, even if it is weeks later. This will help when presenting this information to the other drivers insurance company. Contact the parents repeatedly until they give you their insurance info, send a certified letter to them if needed. As long as the kid and his parents present the same story to the police and file a claim with their insurance company you should be all set. If not, then you would have to file with your own auto insurance, assuming you have collision coverage on your vehicle. Keep in mind two things; the police report will be helpful, and keep calling the parents until you get some satisfaction. The old saying rings true "the squeaky wheel gets the grease". Good luck!

If you don`t have any witnesses you can`t do nothing. They can even never pay you for damage. It`s on their good will and honesty now will they pay you the damage. Insurance company will not cower it assuming that police was not called so they don`t have damage report. From where I come from we have several methods to resolve this kind of a situation but I think it would be useless in your case.

Your not going to like any of this,,, However you need to protect yourself right now... You need to contact an attorney to represent you.. You have opened a pandoras box so to speak. 1. No matter how innocent the accident may have appeard to you,, this woman can claim a myriad of Injuries. Without a Police report you have no defense. Don't ever ever do this again,,, We are in a litigous society,, and you just became a meal ticket,, Your only hope is this woman is in this country without legal status. U need to protect yourself now,,,,

File it through your insurance, is the easiest thing to do. If you don't have collision coverage, you'll need to get a couple estimates, and file in small claims court.


You can't file with THEIR insurance - you can only sue the driver, and the owner, of the "at fault" car for your damages, lost wages, court costs, and loss of use of the car.

Call your insurance company and give them all of the information. Follow their instructions exactly. Unfortunately, most of them want a police report.

If you are insured do not agree to accept payment from him go through your insurance because your insurance wiil wipe you if you have private agreement.Under Australia privacy laws you cannot get the owners name anymore from the rego office . It pays to say you have an injury then the polce have to come and then they blame who is in the wrong

in Florida - we have a blue form that if you exchange driver and insurance information, and there is minor damage and no injuries - just take the form to your insurance agent - and they handle it from there - call you local law enforcement and see how to proceed! -
And call your insurance agent - that's what you pay them for!
