Let the courts take care of it. Courts favor a child to be with their mother but it sounds as if you can prove her unfit. Don't call DHS unless it is a neccesity, they may put him in foster care because you two aren't wed and living together. Call a lawyer (consultations are usually free), he/she will tell you what to do. Until then, she is breaking the law by keeping the child from his father if he has visitations, so until the court day, make sure you ask the lawyer to handle that for you too! GL!!!!!!!! (A parent has the right to visitations whether child support is up to date or not, so if it has fallen behind some, don't worry about that right now) I just thought I'd mention that, it happens sometimes this time of year.

He needs to go to the court house with the assistance of CPS and file to get custody of his child. He knows that the mother is on drugs and the grandmother home isnt stable.He has enough documentation to get a hearing. The grandmother is getting an SSI check not a mental check. If you plan on attending these proceeding with him be ready to have your back ground checked. Dont be so ready to judge this female. We all make mistakes in life hopefully this experience will wake her up.

Your boyfriend will have to take his ex to court to get custody. So he had better just hire a lawyer and start the process now. Better to get the child out of that environment now than later. He also needs to record everytime he goes over there to pick up his son and if he does not get to see him write it down for the lawyer. It looks good in court. Just make sure you two have a place that Child Welfare will approve of living in and that it is has all the child protection locks too. Talk to the lawyer and do everything they say to do to get your boyfriends son.

Take them to court and file for custody. That way they will know that his mother is an unfit mother and the living arrangement is bad. Good LUCK. That's the best thing that you can do. If you your boyfriend files for custody and says that she is an unfit mother, they will check out the house and determine the which place is better for the child to live in.

I've been in your shoes. and now my boyfriend is the custodial parent of his son.
If in fact your boyfriend is on the birth certificate, all he has to do is go to the local superior court or find it online and file an order of child custody and parenting time. The website is very helpful and you can print out the forms and take them to the court house it may take time, but be patient and Good Luck!

he needs to take her to family court. unless there is some kind of court order he don't have much say in the matter. if blood work has not been done proving he is the father that will have to be done as well. if they have already been through all that he will still need to take her to court to get a court order for visitation, maybe even custody if the kids mom and Gram are as bad as you say.

Go to child services immediately and call the police. Clearly, that little boy is in danger, paticularly considering that his mom and her mom are in no fit state to be caring for a child. Take action immediatley, you are right in feeling concerned for hi welfare. Good Luck! :)
