Is it legal to sell an unsmoggable car "as-is?"?

I have a car that fails to pass smog due to a transmission conversion. I'm wondering if I can legally sell the car and transfer the title "as-is" without having to smog it for the buyer.

As long as the buyer is made aware of the 'as-is' condition and why you can't get it to pass the inspection.

In Texas it doesn't matter if its from an individual (called "casual sale")
