My husband was pulled over by the North Chicago Police Department IL. He didn't have the correct insurance card in the vehicle. He called me and I brought the right card. The North Chicago police towed impounded his vehicle. It costs 500.00 to get the vehicle out plus towing costs at 145.00 daily and 45.00 accrual daily.
In order to get the vehicle out we must pay the 500.00 in cash USD .
Does this seem legal?
He was speeding by the way. Which I accept and he accepts.

I'm in law enforcement, and unless there is more to the story, in our state, towing a vehicle in this manner is not mandatory. You cannot tow for speeding, unless he was going to jail for criminal speed, or like I said, there was more to the story. Was your husband being disorderly? Could you not get there with the proof of insurance in a timely manner? Maybe you should contact your local authority, ask to speak to someone that works in the office, not on the street, and ask them their policy for that particular situation. Go to you local Law Library ( in your courthouse) and ask to see the llinois state statute book.

Here's my question to you....did you know that if you don't have proof of valid insurance that the police STILL look on the computer to see if the person they pulled over does? Which means in a court of law you could probably contest this and make the state pay to get your vehicle out? You should go to a lawyer if you do consider this.

I would talk to a traffic attorney and see if you have any basis to recoup the charges. It seems pretty harsh to impound a vehicle for the wrong insurance card, especially if you brought the current one. Normally you would get a ticket and just have to show the judge the current card to gett he ticket taken away.

i dont think it is ...but then again it is IL and chicago at that..the legal system in this state is wack ... i had a friend who got pulled over in the parking lot..for not wearing a seat belt! I would definately talk to someone ( if you have a lawyer friend or someone) and figure out if the police somehow did something wrong... I mean its not like your husband didn't have his insurance card..he just had the wrong one...I believe the police department is at fault.

That is crazy! I don't live in Chicago but I wrecked my car back in march and at the time I didn't have the correct insurance card. All I had to do was fill out a paper with the correct information and send it to the police department. Something doesn't seem right.

Get a good lawyer. If the law says he has to carry the insurance proof he has to have. Some states just give you the ticket and then you show proof. That is a stiff fine!

The law states that you must have your DL. Reg, and insurance card in possession, not have some one bring it to you.

If you brought the right insurance there should not be a problem. Your husband sould of gotten his ticket and be able to drive home.

Try to avoid being pulled over by the Mississippi State Troopers and don't get nervous. How to chill, I don't know. There's a lot of water under the bridge.
