Don't want to fix car because niece's dad is mechanic and he can do it for less and she can have a car. I also lost the title. Can they just get a lost title or do I have to. Do I have to register it in my name first in Ca. I never drove it and I have had it for 6 months.

Neither one of you can apply for a lost title in this case because the title isn't in either of your names. If you never registered it, and lost the title, the title is still in the name of the person you bought it from, and legally it's still his car. You will need to go back to the person you got it from, explain you lost the title, pay the cost of applying for a lost title which will be sent to the owner of record, and hope that he will then sign it over to you again.

Once that happens you can get the title in your name, and then sign it over to your niece.

You will have to:
1. Notify the old owners of the car that you never registered the car.
2. They will order a duplicate title in CA, wait for it to come in the mail. They will most likely be angry, because now it looks like they have owned the car all along, and will be forced to pay back taxes and penalties and fees for all the time they thought you had it registered. Once they pay all this, and get plates again and get their new title, they can sign it over to you.

3. You will take that title and REGISTER it in your name. Get your own plates and wait for your title to show up (the new one that has YOUR name typed on the front of it).

4. Once you get your title, you will sign it over to your niece's dad, and he will go pay taxes and register the car in his name and get his own title and license plates.

If for some reason, you cannot find the old owners, you will need to go to court in California, and try to get the car into your name with any documentation you may have from the purchase of the vehicle.

If the title was signed over in your name you can go and have a duplicate title printed up. No the car does not have to be registered to receive a new title. and yes they can register it. They just have to show a bill of sale and it must contain your signature along with theirs and a third party witness. If the title is still in the original owners name then they would need to apply for a duplicate title. then sign it over to you. Or just leave it blank and have your niece's dad sign the title.

go back to the last owner have them sign a pink paper its called a application for duplicate title,and a bill of sale put your name as new buyer and give your niece a bill of sale for $0.dollars as a gift.you pay for 2 transfer and tax of 8.25% on what you paid for it. call 1 800 777 0133 the dmv, and they will send you the forms
