Call your immigration office near you (use 411 to ask for the number), report to them what happened, and hopefully you got his liscence plate number? DONT settle out of court! That is a MISTAKE, free money for him, and you get s c r e w e d! Let it go to court! He'll be a NO SHOW if he is illegal! If he does show up, he will lose. Get the police report, request it from the cop who came to the accident. You did have a cop come to the accident right? If you can afford a lawyer, get one, and he/she will do all this work, but if youre going in pro per(meaning you are youre own lawyer), you will have to do all the investigating yourself. Whatever you do, DONT give him any money! That is what he wants, and he wont take any blame for the accident. He is trying to intimidate you, DONT let him! Good Luck!

Did you get his license info? If not then there is a chance he is illegal. If he doesn't have a license and insurance, then he is in the wrong, especially if he is illegal. Shouldn't have been on the road to begin with.
This is what I suggest you do. Get his license status and number, get his insurance information, name address, work information, everything you can on him. Watch or listen to his reaction when you ask and he answers, that will give a big clue as to his status in this country. I would also get a lawyer if I were you. Call the INS# that someone else posted for you. Good luck.
And, if he is illegal, then it is 100% his fault because 1. He should even be in this country, and 2. Because he shouldn't have been operating a motor vehicle

Don't settle out of court. Don't assume that all the immigrants are illegal. If you go to court they will sort it all out. If he is illegal he probably will not show up and they will throw it out.

First of all, if your problem is with the amount of money you have to him, then go through your insurance company. You do have insurance, right? Secondly, why didn't you ask him to show you his Driver's License? Illegals aren't allowed to have a driver's license.
Call your local police department, and ask them this question. They should be more than happy to help you out.

You could report your suspicions to ICE. Or you could ask the police to investigate it. Since you are going to court, just tell them that you believe his immigration status is relevant to the lawsuit.

If you are sued then you can file interrogatories and request production of documents
Ask questions about his citizenship and request production of immigration papers
BTW - anyone who tells you that you will win simply because he is an illegal immigrant is completely wrong. negligence is neglicence, no matter who gets hurt
