He has not been in any trouble, but 6 months ago she threw him out saying her new husband didn't want him there.

We are just family friends, but he is still living with us and sleeping on the sofa. This is not an ideal situation, but we don't know what to do. He just wants to go home.

Could she be prosecuted? If so under what law?

I have already tried CAB, and they are still looking into it.

Any practical advice would be welcome

Unfortunately yes she can under section 20 she could simply walk into social services and hand him over. I feel sorry for the woman who must be feeling really down after choosing her new man instead of her own flesh and blood. You don't say whether she has anymore children. Also you could go to social for financial help for the boy. They would also contact the mother to see if she could be helped to change her mind. You could also try the RSPCC.

If she doesn't want him living with her, social services could become involved and find a home for him.

She may be guilty of neglect but if she sent him to stay with you then probably not.

I'm not sure there is a lot you can do. I think the best move would be family counselling so that feelings can be explored as to WHY the new husband doesn't want him there. It's also baffling that a mother would throw out her child because of her new husband.

Do you think the child found it very difficult adapting to the new arrangement with step father?

I think the only option is some counselling for all the family or at least the mother and son.

This is a very sad situation and very good of you to be taking care of this young troubled lad.

No, she cannot refuse to look after him. He is still considered to be a minor, so as a parent, she is legally liable for his well being. I'd call the police and see if there is anything that they can do. What about the kids father? Is he still around? Is that an option for him.

The only thing about bringing this boy back to his mother's place is how she will treat him if and when he goes back.

citizen's advise - first port of call
i reckon she could probably be persectued, but you gotta ask how effective it would be and if she is a mother worth having, god forgive me for saying it.
i'm not saying you should adopt the child, but it may not be in his best interests to be with his mom in which case he would probably go to child services until he turns 16, at which point i think he can try to live independently - maybe you can support him till then? this is such a crucial time in terms of school and just becoming a decent human being that any example you set now could really have a deep impact - not that it's your responsibility.
i'm sending you positive vibes, you wouldn't wish that on your worst enemy, i hope all works out for you and the son.

why dosen't he take her to court and file for a child parent divorce! he could then take her and the new bloke to the cleaners! and set up his own life when he turns 16! poor lad, he deserves better than that.

That is horrible. She can be charged with neglect. If you wanted him to stay with you, you could go to court to become a legal guardian....

What does the child's Father say? Is he paying support to this woman?
