My friend came from Germany for few month to work in England. But as he needed money,he had to start work immediately. He didn't have a NI number so I gave him mine. Now he is using my national insurance number but his name to work. The thing is that his boss paid him last week around £178 taxes,on my insurance but his name. Can he get caught and can I get in trouble for this?Thank you

My mate told us that As long the NI is not fake,the taxes will go in it and it won't be any trouble. He works for Inland Revenue.
My friend didn't have time to apply for NI

OK, this is bad.

You have commited a criminal offence; Defrauding the inland revenue, tax evasion, and allowing an illegal Alien to work in the UK without the correct Revenue clearance.

It is not too late.

First, foremost, and do it tommorrow - Get your friend to the local tax office or phone them up (Phonebook). They will just ask him a few Questions, and he will have a NI no. in no time.

I have employing EU nationals for YEARS and have never encountered strenuous delays. I have certainly never seen any situation where this level of Fraud is justifiable.

Now, the hard part; explain to HMRC what you did. Hope you get the person on a good day, and explain rationally that you made a bad, spur-of-the-moment choice, and you accept that it was not right. They may be lenient and not be too harsh.

From there, they will sort the mess out the best they can.

wow you are in trouble

he didn't need a NI number to start work. Phone the TAX office NOW nd tell them what has happened. You are actually commiting tax fraud and could go to prison

Sort this out now you could get into a lot of trouble. He should have applied for the appropriate papers to work in the UK. The Inland Revenue will find out.

Not only can you get in trouble, you probably already are.

Though I really doubt your story as the tax office would have noticed the difference between name and NI number

You need to put this right as soon as possible...its major fraud...and of all the people you don't mess with the Tax Man is number one...with everything being on computer it wont take long before you are discovered in anycase...

What were you thinking!!

You can start working (EU citizens) legally without NI number, using temporary one. There was no need for what you did.

It sounds like it would be considered some sort of fraud. The government take money matters more seriously than life, so no doubt there'll be trouble.

By now the tax office would have found this out, so

1) If this is the truth - HIDE QUICKLY
2) If you were just testing - you have been found out
3) If you just posted to get 3 points - YOU DID

Yes, this is highly against the law. Both/Either of you could be prosecuted for it. Plus it means your friend is working illegally and the employer is liable as they did not check the names.

It actually counts as electoral fraud
