I'm trying to start a collection of both, but need the legal aspect first.

Legal to own... YES

Legal to carry... depends upon the length of the blade. Longer than 4 inches... NO, Double-edge blades... NO.

Check with the local aurthorities.In New York State, I would think you need a permit to carry a toothpick.
