Outside a bar, two females got into an argument. The shorter female, kim, broke a bottle and threatened the taller girl, jill. Michelle who had been trying to stop the confrontation intervened as soon as the bottle was poised in a threatening manner. Michelle is a trained in martial arts. Instinctively, michelle grabbed the arm with the bottle and pushed kims face into a wall ... the bottle dropped. Kim swung at michelle. Michelle protected herself with one swift hard kick to kim's genitals. Kim cupped herself, fell to the ground and curled up. Michelle and Jill left. Kim sustained a tear to her groin and mild nerve damage because the kick landed on her hood and pushed the nerves into her pubic bone, which pinched the nerves. Kim is both pressing assault charges and filing a law suit claiming Michelle had no right to intervene in the conflict and because she is trained she used her training to cause grevious bodily harm. The police did not arrest her, yet law suit stands.

She won't lose. She was defending herself and it doesn't seem like she used more force than neccessary. She didn't kick them while they were on the ground or anything, just enough to incapacitate them. That's funny though, I bet that girl who got kicked will think before she kicks a guy in the nuts.

The way the law works nowadays your karate friend should have let you friends face be slashed while ringing the police. When they turned up (after the ambulance) they would write out a report for their employers (the insurance company). The insurance firm could then tie things up for years while your friend paid for plastic surgery which was not covered . Judges and solicitors would field lies for years on end. Everybody does well out of this system except Jill, but it's for the greater good of many people that we must calmly sacrifice.

SO she isn't facing charges. She is being sued. Fair has nothing to do with our torts system she needs to get a lawyer and fight back. If everything you say is true she should win and depending on the state you live in, I'm assuming you're in the US, she can demand that Kim be forced to pay her legal bills.

A decent lawyer will destroy this case in court...Kim could end up paying off Michelles' mortgage and car payments.

a civil suit may be filed against anybody for anything. Have to pay the law people to do their thing, thats their racket.

Move to Florida and buy a gun. The law is different in Florida.
