The person coming out of the driveway is at fault. I know that it is difficult to see oncoming traffic sometimes, but it is the responsibility of the person pulling out to look, roll down his/her window, and listen for traffic. I live just over the top of a hill, and I am often unable to see oncoming traffic. I usually just open my window, listen for a few seconds and then go when I know it's safe. Whether someone waves you in or not, you have to wait until you can see if it's safe.

If I understand your information, the car pulling from the driveway is at fault. A driver entering the roadway has to yield to oncoming traffic. If a police report was filed, it should list who was at fault.

I say it the person who pulled out of the driveway is the fault because they should have been looking behind them to see if their is oncoming cars driving by.

The cars already on the road have the right of way so the one coming out of the driveway should yield. Therefore the one coming out of the driveway is at fault. Even though someone motioned him to go he is supposed to check for himself that traffic conditions allow him to proceed safely.

I would think the car going for the left lane. Should be watching all your surroundings. And I think I read somewhere that the person pulling out (from a driveway or the side of the street) has the right of way. But dont count on my word alone.

I would say the person who flagged them out of the drive way! But I think the law would say the person who hit from behind!
