yes, you can sue. anyone can sue anyone, for anything. but whether they win or not is a different story. i work at a store similar to kmart, and we prosecute anyone who steals anything over $15. Think...what do they gain by charging you all that money? you go here and tell all of us that they charged you $400...and you probably told your fam. and friends too, right? well that sends out the message to all of us to NOT STEAL FROM KMART. that is exactly what they want. the moral of this story is to not steal from kmart.

I would suggest asking your lawyer where the $400 charge came from. Normally the store isn't the one who is charging you anything - the courts are charging you court fees and what not.
The worst that could happen... If this is your first offense you will probably get a year of probation - plus court fees and restitution.
Good Luck... I don't know why you stole, that's not my business, but I hope that you don't wind up becoming a repeat offender! Just learn from this, make the most of the situation and move on!!

Maybe next time you will think twice about stealing. That $400 dollars is what they call civil prosecution. That's some expensive games to pay for huh ? Your gonna sue K-mart for giving you a fine for stealing from their store ? That's too funny.

Good!! Maybe you will learn your lesson. Its those of us who don't steal that pay for those like you who do, with price hikes to cover the stolen merchandise. Your punishment is to teach you a lesson. Are you learning? Crime doesn't pay!! Of course your going to get a huge fine. Why wouldn't you? If this is your first offense, you most likely will get off easy, and do probation and restitution.If you should repeat this act, you most likely will do some time in the local jail.
